1. What This Tool Is

Emeritas is a profile evaluation and petition review tool that provides informational analysis of EB-1A extraordinary ability immigration profiles and drafted petitions. It is similar to a standardized test practice tool or a self-assessment questionnaire — it provides structured feedback based on publicly available regulatory criteria, but it is not legal advice and does not substitute for the guidance of a qualified immigration attorney.

No attorney-client relationship, fiduciary duty, or professional engagement is created by using this tool. The operator of this tool is not an immigration attorney and does not practice law.

2. Information We Collect

When you use this tool, we collect the following information:

  • Profile information you provide: Name, field of expertise, years of experience, country of birth, and your responses to each of the 10 EB-1A criteria questions.
  • Uploaded documents: If you upload a CV or petition PDF, the document is processed for analysis and is not stored after the evaluation is complete.
  • Evaluation results: The assessment of your profile, including scores, criteria analysis, and research findings.
  • Survey responses: If you complete the feedback survey, your ratings, preferences, and any feedback text you provide.
  • Email address: Only if you voluntarily provide it during payment or feedback submission.
  • Payment information: Processed by Stripe. We do not store your credit card details — Stripe handles all payment data per their security standards.
  • Technical data: IP address (for rate limiting only — not stored long-term), browser type, and access timestamps.

3. How We Use Your Information

  • To generate your profile assessment, petition review, and evaluation results
  • To improve the accuracy and quality of the evaluation tool
  • To analyze feedback in aggregate
  • To enforce rate limits and prevent abuse
  • To process payments and deliver purchased services
  • To contact you about the tool only if you voluntarily provide your email

4. Third-Party Services

Your information is processed through the following third-party services:

  • Third-party processing service: Your profile responses and uploaded documents are sent to a third-party processing service for analysis. Per the provider's policy, inputs are not used to train their models.
  • Stripe: Payment processing. Stripe handles all credit card data per PCI compliance standards. See Stripe's privacy policy.
  • Vercel: The application is hosted on Vercel. Vercel processes requests and may log technical metadata.
  • Upstash: Evaluation records, feedback, and survey responses are stored in a secure database.
  • Resend: Email notifications are sent via Resend for administrative purposes.

5. Data Retention

Evaluation records and survey responses are retained for the purpose of product improvement and service delivery. Uploaded documents (CVs, petitions) are processed in memory and are not stored after the evaluation is complete. If you would like your data deleted, contact us at the email below.

6. Data Security

We take reasonable measures to protect your information. All data is transmitted over encrypted connections (HTTPS). Sensitive credentials are stored as server-side environment variables and are never exposed to clients. Payment data is handled entirely by Stripe and never touches our servers. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

7. Your Rights (Including GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or other jurisdictions with data protection laws, you have the following rights:

  • Right of access: You may request a copy of the personal data we hold about you.
  • Right to rectification: You may request that we correct inaccurate data.
  • Right to erasure: You may request that we delete your personal data.
  • Right to restrict processing: You may request that we limit how we use your data.
  • Right to data portability: You may request your data in a structured, machine-readable format.
  • Right to object: You may object to processing of your personal data.

Legal basis for processing (GDPR): We process your data based on your consent (you voluntarily submit information through the assessment form) and our legitimate interest in improving the tool.

8. Cookies

This tool uses browser localStorage to save your assessment progress locally. We do not use tracking cookies, advertising cookies, or third-party analytics cookies.

9. Children's Privacy

This tool is not intended for use by individuals under 18 years of age. We do not knowingly collect personal data from children.

10. Changes to This Policy

We may update this privacy policy from time to time. Changes will be posted on this page with an updated revision date.
