Terms of Service

1. Acceptance of Terms

By accessing or using Emeritas ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

The Service provides two products: (1) EB-1A Profile Evaluation — an assessment of your extraordinary ability profile against USCIS regulatory criteria, and (2) Petition Review — an audit of your drafted EB-1A petition for weaknesses, RFE risks, and evidence gaps. The Service is not a law firm, does not provide legal advice, and does not create an attorney-client relationship. See our Privacy Policy for data handling practices.

3. Intellectual Property

The Service, including but not limited to its software, evaluation methodology, scoring models, user interface design, analysis framework, and all associated documentation, is the proprietary intellectual property of the Service operator and is protected by copyright and other intellectual property laws.

You may NOT:

  • Copy, reproduce, modify, or create derivative works based on the Service or any part thereof
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code, algorithms, or evaluation logic of the Service
  • Scrape, crawl, or use automated tools to extract content, data, or evaluation outputs from the Service for the purpose of building a competing product or service
  • Resell, sublicense, or redistribute the Service or its outputs to third parties for commercial purposes without written permission
  • Use the outputs of the Service to train, fine-tune, or improve any machine learning model or system
  • Remove, alter, or obscure any copyright notices, trademarks, or other proprietary rights notices on the Service

Evaluation reports and petition reviews generated by the Service are licensed to the individual user for their personal immigration planning purposes only. They may be shared with the user's immigration attorney but may not be commercially redistributed, published, or used as a template for competing services.

4. User Responsibilities

  • You are responsible for the accuracy of the information you provide. The Service evaluates based on what you submit.
  • You agree not to submit false, misleading, or fabricated information.
  • You agree not to upload documents containing malicious content.
  • You agree not to use the Service for any unlawful purpose.
  • You agree not to attempt to bypass payment mechanisms, rate limits, or access controls.
  • You agree not to share promo codes publicly or use them in ways not intended by the Service operator.

5. Uploaded Documents

When you upload documents (CVs, petitions), they are processed for the purpose of generating your evaluation or review. Uploaded documents are processed in memory and are not permanently stored on our servers after the analysis is complete. You retain all rights to your uploaded documents.

6. No Legal Advice Disclaimer

THE SERVICE IS AN INFORMATIONAL TOOL AND DOES NOT CONSTITUTE LEGAL ADVICE. No attorney-client relationship is created by using the Service. The Service operator is not an immigration attorney. Scores, ratings, assessments, and recommendations may contain errors and should not be relied upon as the sole basis for immigration decisions. You should consult with a qualified immigration attorney before making any filing decisions based on the information provided by the Service. The Service operator assumes no liability for immigration case outcomes.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE SERVICE OPERATOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE, IMMIGRATION CASE OUTCOMES, OR RELIANCE ON EVALUATION RESULTS.

8. Payment and Refunds

Paid features are offered on a one-time payment basis. Payments are processed securely by Stripe. Promotional codes are subject to availability and usage limits. Due to the nature of the content (which is produced and delivered immediately upon payment), refunds are generally not available once an evaluation report or petition review has been generated. If the Service fails to produce a result due to a technical error, you may request a re-run or refund by contacting hello@emeritas.pro.

9. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page. Continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in the appropriate courts of the United States.
